Licensing

In this part of the CEFTA Web Portal, you will find information on the trade licensing system separately for each CEFTA Economy. The licensing system is divided into two parts: import/export licensing and trade licensing. This web portal focuses on import/export licensing. Trade licensing is mentioned only as a reference. Import and export licensing includes: 1.The procedures to be followed for obtaining an import and export license; 2.The documents that must be presented to the relevant authorities in order to obtain the approval of the license; 3.The official documents you will receive after obtaining approval of the license; 4.The validity period and scope of each license. Laws and regulations

Products subject to permits regime for import and export are listed in the Decision on classification of goods on the regimes of export and import   (Official Gazette BiH, No. 22/98, 30/02, 20/02, 20/05 and 4/13).

This decision regulates classification of goods onto the following individual export and import regimes:
- free export;

- permit based export;

- free import;

- permit based import.

 Marks for goods from the aforementioned regimes are the following:

"LB" – goods exported i.e. imported freely;

"D" – goods exported i.e. imported based on permit.

 

Procedures for issuing permits

Procedures for permit issuing or certain types of goods differ based on the nature of the goods and the authorising body.

Permits for goods for reproduction and plant protection (Annex 1 of the Decision) are issued by the Administration for Plant Health Protection BiH. For more information see the link on phyto-sanitary regulations.


Permits for goods for reproduction and protection of animals (Annex 1 of the Decision) are issued by the Veterinary Office BiH. For more information see the link on veterinary regulations.

Permits for opiates, medications, blood and its fractions and similar pharmaceutical products (Annex 2 of the Decision) shall be issued by the Ministry of Foreign Trade and Economic Relations BiH, with consent and opinion of authorised state and/or entity bodies in BiH.
In case the given medications, medical devices or opiates are registered for free circulation in BiH, the consent shall be issued by the Agency for Medications and Medical Devices BiH. All products with prior registration at Entity level shall be accepted on the territory of whole BiH by the Agency. The forms for filing the request for issuing the consent for certain types of goods can be found at web site of the Agency (www.almbih.gov.ba).

Upon obtaining the consent, it is required to file the request for issuing the import permit to the Ministry of Foreign Trade and Economic Relations of BiH, using the Request form  for the use of import of goods based on "D" permit issued by the Ministry. The request and appropriate supporting documentation shall be forwarded directly to the Ministry. The permit for registered medications shall be issued for the period of six (6) months while for non-registered medications it shall be issued for single usage.


The Ministry of Foreign Trade and Economic Relations BiH also issues the permits for export or temporary export of art work. The request shall be filed on the Request form  for use of the export of goods based on permit "D" issued by the Ministry with prior consent of the competent entity ministry of science and culture. The permit for temporary export also includes the deadline for the return of the given goods into BiH.  

For sports weapons and ammunition, as well as military weapons and equipment, classified per export and import regimes based on "D" permit, listed in the Listing of other goods (Annex No. 3), the consent shall be issued by the competent entity ministry, while the permit is issued by the Ministry of Foreign Trade and Economic Relations BiH. For all other goods classified according to individual regimes of export or import based on "D" permit, listed in the list of other goods (Annex No. 3) the consent shall be issued by the competent entity ministry while the permit is issued by the Entity Ministry of Trade.
