Sanitary and Phytosanitary & Veterinary regulation

In this part of the CEFTA Web Portal you will find the most important sanitary, phytosanitary and veterinary control procedures to be followed for each CEFTA Economy. The information about the control procedures includes but is not limited to: 1.The location of sanitary, phytosanitary and/or veterinary control offices including working hours in each office; 2.A description of sanitary, phytosanitary and/or veterinary procedures; 3.The documents asked by the respective authorities in order to obtain approval for entering, transiting or exiting the territory of the respective CEFTA Economy; 4.The officially approved documents issued by the respective authorities; 5.A description of the official procedures for sampling. What is subjected to the Sanitary Inspection

 

In the Republic of Moldova, the Ministry of Agriculture and Food Industry, by the General Inspectorate of Phytosanitary Supervision and Seeds Control, is the administrative authority responsible with the implementation of state politics regarding phytosanitary quarantine.

Laws and Regulations

In the Republic of Moldova  phytosanitary control is stipulated in the following legal provisions. Law of phytosanitary quarantine no. 506- XII from 22.06.2010 regarding phytosanitary quarantine, Government Decision no.920 from 30th August 2005 regarding “the list of codes of authorizations, permits and certificates issued to physical and legal bodies wanting to develop management activities, by central administrative authorities and the departments subordinated to them”, annex no. 2 “the list of goods subject to phytosanitary quarantine”, the regulation regarding the method of collaboration between the Agency of Sanitary-Veterinary and Safety of Animal Origin Products, the General Inspectorate of Phytosanitary Supervision and Seeds Control and the Custom Service during the process of state control of import / export and transit  goods subject to sanitary-veterinary control or phytosanitary quarantine, approved by Government Decision no. 1073 from 19th September 2008.

Where is Sanitary Inspection Conducted

On the territory of the Republic of Moldova, the import and transit of plants and vegetable origin products represents the object of phytosanitary control, which is made at the import points or, in case of necessity, at the state national border checkpoints.
The export and re-export phytosanitary certificate is issued to the owner of the load, by the territorial authority of the General Inspectorate of Phytosanitary Supervision and Seeds Control corresponding to the area where the load is being exported, in view of presenting it to the representatives of the authority responsible for the phytosanitary quarantine from the importing economy.
The list of border checkpoints where the crossing of goods subject to sanitary veterinary control or phytosanitary quarantine is permitted is presented below.

Special conditions for importers and exporters

 

The issue of import/transit permits is governed by the General Inspectorate of Phytosanitary Supervision and Seeds Control, in conformity with Law no. 506- XIII from 22.06.1995 regarding the phytosanitary quarantine, Government Decision no. 920 from 30.08.2005 regarding the list of codes of authorisations, permits and certificates issued to physical and legal bodies wanting to develop management activities, by central administrative authorities and the departments subordinated to them and the Classification List of the products subject to phytosanitary quarantine approved by Government Decision no. 1073 from 19.09.2008 regarding the optimise of crossing the national state border by means of goods and passengers’ transport, the modification and appeal of some laws.

The issue of phytosanitary certificates for export and re-export is made by the General Inspectorate of Phytosanitary Supervision and Seeds Control, in conformity with Law no. 506- XIII from 22.06.1995 regarding the phytosanitary quarantine, Government Decision no. 920 from 30.08.2005 regarding the list of codes of authorisations, permits and certificates issued to physical and legal bodies wanting to develop management activities, by central administrative authorities and the departments subordinated to them and the Classification codes of the products subject to phytosanitary quarantine approved by Government Decision no. 1073 from 19.09.2008 regarding the optimise of crossing the national state border by means of goods and passengers’ transport, the modification and appeal of some laws.

Import / Export / Re-exsport / Transit procedure

Import and Transit

The vegetable origin products used for commercial or seeding purposes are admitted only after the phytosanitary control and the issue of a phytosanitary import permit.
For the transit of vegetable origin products, the issue of a transit phytosanitary permit is required.

The import of the following is prohibited.

In case of finding phytosanitary quarantine objects, the General Inspectorate of Phytosanitary Supervision and Seeds Control will take the following measures.

The payment for these measures is made by the owner of the load.
In the eventuality that the owner refuses to take the above mentioned measures, the phytosanitary inspectors will apply, on the phytosanitary certificate, a stamp reading “refused entry”, indicating the inspector’s name and the date of refusal.

Export and Re-export
The production, materials and objects subject to quarantine and destined to export and re-export must be accompanied by phytosanitary certificates, to demonstrate the fact that the production, materials and objects subject to quarantine and destined to export or re-export fulfil the phytosanitary requirements of the importing economy.
The issue of phytosanitary certificates for re-export is made on the basis of the certificate issued for the load in the exporting economy and the future export is accompanied by the phytosanitary certificate.
In view of obtaining the phytosanitary certificate, the owner of the load brings, to the institution which corresponds to the General Inspectorate of Phytosanitary Supervision and Seeds Control, the necessary documents previewed by Law of phytosanitary quarantine no. 506- XII from 22.06.2010 regarding phytosanitary quarantine, at least 24 hours before dispatch.

The validity term of the phytosanitary certificate is 14 days from the date of issue.
